How Can the Quota Employment Obligation Be Fulfilled?

An employer may fulfill the employment substitute quota for persons with disabilities provided that the mutual rights and obligations defined in a Business Cooperation Agreement with Manola Studio, i.e. with a self-employed person with a disability, are properly fulfilled.

 

From the official extract of the competent authority’s register, it must be evident that the self-employed person with a disability (or the legal entity with whom the agreement is concluded for the purpose of fulfilling the substitute quota) has a registered business activity that corresponds to the subject of the Business Cooperation Agreement with the quota-obligated employer.

 

What Must Be Defined in the Business Cooperation Agreement with a Self-Employed Person with a Disability?

The agreement must specify:

 

the subject of the agreement,

the value of each type of service, product, work, or task, as well as the total agreed value (excluding VAT),

the deadline for fulfilling contractual obligations,

the payment deadline.

 

In addition, proof of disability of the self-employed person must be attached to the agreement.

How Is Substitute Quota Fulfillment Announced?

 

Substitute quota fulfillment is announced by submitting:

 

the Business Cooperation Agreement, and

the Notification of Substitute Quota Fulfillment Form (N-IZK).

The substitute quota becomes valid from the month in which the documentation is received. It can be announced for a maximum period of twelve months in advance. After this period expires, a new notification is required.

What Is the Minimum Value of a Business Cooperation Agreement?

 

The total value of the agreement, excluding VAT, must be at least 20% of the minimum monthly wage in the Republic of Croatia for each person with a disability that the employer would otherwise be required to employ under the prescribed quota.

 

If the agreement is concluded for a period longer than one month, the average monthly value of the agreement (excluding VAT) must amount to at least 20% of the minimum monthly wage in the Republic of Croatia for each person with a disability that the employer would be required to employ under the quota.

When Is the Report on Fulfillment of the Announced Substitute Quota Submitted?

 

The obligated employer must submit a Report on Mutual Fulfillment of Contractual Obligations to the Institute within eight days after the contractual obligations have been fulfilled, using form I-IZK 1 / I-IZK 2.

 

If the agreement does not specify a duration period, the report must be submitted within eight days after the end of the period for which the substitute quota fulfillment was announced.

 

At the request of the Institute, the parties are required to provide additional evidence of mutual fulfillment of contractual obligations, such as bank statements or other relevant documentation.

 

The report form must be signed by:

 

the responsible person of the obligated employer, and

the self-employed person with a disability (or the responsible person of the legal entity with whom the agreement was concluded for the purpose of substitute quota fulfillment).
